ПРАВОВЫЕ ПРОБЛЕМЫ ПРОИЗВОДСТВА В СУДЕ КАССАЦИОННОЙ ИНСТАНЦИИ В АРБИТРАЖНОМ ПРОЦЕССЕ

В статье рассмотрены правовые проблемы производства в суде апелляционной инстанции в арбитражном процессе. Показано, что принятие кассационной жалобы и возбуждение производства по ней осуществляется судьей единолично в пятидневный срок со дня ее поступления в арбитражный суд кассационной инстанции. Выявленные несоответствия жалобы установленным требованиям могут повлечь за собой оставление жалобы без движения или ее возвращение.

The article discusses the legal problems of production in the court of appeal in the arbitration process. It has been shown that the adoption of the cassation complaint and the initiation of proceedings for this proceeding are carried out by the court on its sole decision five days from the date of its arrival in the arb d cassation instance. Revealed inconsistencies of complaints to established requirements may entail the abandonment of complaints without moving the sludge and its return.
