РЕАЛИЗАЦИЯ ПРИНЦИПА ВИНЫ В РОССИЙСКОМ УГОЛОВНОМ ПРАВЕ

В статье рассмотрен один из основных принципов уголовного права – принцип вины. Проведен анализ точек зрения различных ученых касаемо применения объективного и субъективного вменения. Во избежание применения ошибочных трактовок понятия принципа вины автором предлагается определение «вины».

The article considers one of the basic principles of criminal law – the principle of guilt. The analysis of the points of view of various scientists regarding the use of objective and subjective imputation is carried out. In order to avoid the use of erroneous interpretations of the concept of the principle of guilt, the author proposes a definition of “guilt”.
